These Terms & Conditions ("Terms") govern your access and use of The Klub platform, including its website, mobile applications, and services (collectively, the "Services"). By using The Klub's Services, you agree to comply with these Terms.

1. Acceptance of Terms

By accessing, browsing, or using any part of The Klub's Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our Services.

2. Membership Eligibility

  • You must be at least 18 years old to join The Klub.
  • By registering for an account, you represent that the information provided is accurate and complete.

3. Bookings & Services

a. Bookings:

  • Bookings made via The Klub platform are subject to availability and confirmation by third-party service providers.
  • You are responsible for verifying the booking details, such as guest names, dates, and room types.

b. Payment Terms:

  • All payments are securely processed through Stripe. The Klub does not store your payment details.
  • Payment for bookings will be required in full at the time of booking. Refundable bookings will be governed by the policy outlined at the booking details page.

c. Cancellations & Amendments:

  • Cancellation policies are determined by the service provider and are outlined at the time of booking. Refunds, if applicable, are processed according to the service provider's terms.
  • Modifications to bookings, including changes to dates or guest names, are subject to availability and may incur additional fees.

d. Travel Insurance Requirement:

  • Participation in trips involving physical activities (e.g. hiking, cycling, padel) requires each traveler to hold valid travel insurance that includes coverage for:
  • - Medical expenses and emergency evacuation
  • - Trip cancellation or interruption
  • - Participation in recreational activities
  • By completing your booking, you confirm that you are responsible for obtaining and maintaining appropriate travel insurance for the duration of your trip. The Klub reserves the right to request proof of insurance before the trip begins. Failure to hold adequate insurance may result in denied participation without refund.

4. KLUB Loyalty Program

The Klub offers a loyalty program designed to reward members for their bookings and engagement with our platform.

a. Earning KLUB Points:

  • Members earn KLUB Points based on booking value, with different earning rates depending on membership tier.
  • Points are credited after the stay or activity is completed.

b. Using KLUB Points:

  • Points can be redeemed as partial discounts on future bookings or for experiential benefits like room upgrades.
  • Points do not expire, giving members flexibility to use them whenever they choose.

5. Cookies & GDPR Compliance

a. Cookies:

  • We use cookies and similar tracking technologies (such as Mixpanel) to improve your experience on The Klub platform. Cookies are small files placed on your device to collect standard internet log information and visitor behavior information.
  • When you use The Klub Services, we may collect information from you automatically through cookies or similar technology. For further details, please refer to our Privacy Policy.

b. Your Data Rights (GDPR):

In compliance with the General Data Protection Regulation (GDPR), you have the following rights:

  • Right of Access: You can request access to the personal data we store about you.
  • Right to Rectification: You can request corrections to inaccurate or incomplete data.
  • Right to Erasure: You can request deletion of your data, except where retention is required by law.
  • Right to Object: You have the right to object to the processing of your data for specific purposes (e.g., marketing).

6. Responsibilities & Conduct

You agree to use The Klub Services only for lawful purposes. You are prohibited from:

  • Engaging in fraudulent or deceptive behavior.
  • Sharing your account login details with unauthorized parties.
  • Misusing the platform for unauthorized bookings, including duplicate reservations.

7. Liability & Limitations

a. General Liability:

  • The Klub acts as an intermediary between users and third-party service providers.
  • We are not liable for the performance or non-performance of services provided by hotels or other third parties.
  • The Klub will not be responsible for any damages, injury, or losses incurred during your stay or use of third-party services booked through the platform unless directly caused by our negligence.

b. Limitation of Liability:

  • The Klub's total liability, in any case, will be limited to the total amount paid by you for the specific booking in question.
  • We are not liable for indirect or consequential losses, including loss of profits or goodwill.

c. Participant Assumption of Risk:

  • By booking a trip that includes physical or outdoor activities, you acknowledge that such activities carry inherent risks (e.g. falls, collisions, weather conditions, terrain). You are responsible for assessing your own fitness and preparedness and agree to participate voluntarily and at your own risk.
  • The Klub and its Ambassadors will not be held liable for any injuries, losses, or disruptions arising from your participation, except in cases of gross negligence.

8. Force Majeure

The Klub will not be responsible for any failure to fulfill obligations due to events beyond our control, such as natural disasters, strikes, or governmental regulations.

9. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will take effect immediately upon posting on the website. Your continued use of the Services after changes are made indicates your acceptance of the revised Terms.

10. Governing Law & Dispute Resolution

These Terms are governed by the laws of the United Kingdom. Any disputes arising from the use of The Klub's Services will be resolved in the courts of the United Kingdom.

12. Hosted Trips & Role of Ambassadors

Some experiences offered through The Klub are hosted by athletes, coaches, or content creators ("Ambassadors"). Unless otherwise specified, these Ambassadors are not acting in a professional or certified capacity as tour guides or instructors. Their role is social and non-instructional — intended to enhance the community aspect of the trip.

These experiences are not guided tours, and participants are responsible for their own safety, navigation, pace, and fitness. In some cases, The Klub may contract local certified guides or service providers, but unless explicitly stated, the Ambassador is not responsible for group safety or technical instruction.

By booking, you acknowledge and accept this distinction and agree to assume full responsibility for your participation in any physical activities included in the itinerary.

13. The Klub Referral Program – Terms & Conditions

Eligibility

  • The referral program is open to all registered users of theKlub who are at least 18 years old.
  • Referrers must have an active theKlub account to participate.
  • Referees must be new users who have not previously created an account or made a booking with theKlub.

How It Works

  • Eligible users can access a unique referral link in their theKlub profile under "My Referrals."
  • This link may be shared with friends via email, messaging apps, or social media.
  • When a referred friend signs up using the referral link and completes their first trip, the referrer will receive the referral reward.

Referral Rewards

  • The referrer will receive £25 credit in theKlub points for each successful referral.
  • The referred friend will also receive £25 credit in theKlub points upon signing up and completing their first booking.
  • Credit in theKlub points is applied automatically to your theKlub account and can be used for future bookings.
  • Credits are non-transferable and have no cash value.

Conditions

  • Only one referral code can be used per new user.
  • Referrals must be genuine individuals; self-referrals or the creation of multiple accounts by the same person will result in disqualification.
  • If a referred booking is cancelled or refunded, the reward may be revoked.
  • theKlub reserves the right to disqualify any participant found in breach of these terms or engaging in misuse of the program.

Data Protection & Privacy

  • By participating in the referral program, you agree that theKlub may process your personal data in accordance with our Privacy Policy, in compliance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
  • Any personal data collected for the purposes of this referral program will be used solely for program administration, fraud prevention, and the issuance of referral rewards.
  • You have the right to access, correct, or delete your personal data at any time by contacting us at support@theklub.world.

Changes to the Program

  • theKlub reserves the right to modify, suspend, or terminate the referral program at any time without prior notice.
  • Updates to these terms will be published on our website and will take effect immediately upon posting.

Governing Law

  • These Terms & Conditions are governed by and construed in accordance with the laws of England and Wales.
  • Any disputes arising in connection with the referral program shall be subject to the exclusive jurisdiction of the courts of England and Wales.
